What Is A Defective Product?

A product is defective when it does not function properly in a manner it was intended and causes consumer injury. In such situations, the product is considered unreasonably dangerous, and its manufacturer can be held legally accountable for the injury. A manufacturer may be required to compensate for injuries caused even where the product is “misused” by the consumer where it is reasonably foreseeable that its product may be misused in such way. Whether it is a prescription drug, medical device, automobile, household appliance, or other consumer good, manufactures who have placed dangerous products on the market must be held accountable to safeguard public’s safety.

There are three types of defects that can lead to a consumer injury: design defect, manufacturing defect, and marketing defect. A design defect is a flaw in the product before it is even manufactured. A manufacturing defect refers to a flaw that occurs after the design and during the production phase. A marketing defect is a flaw in the advertising or labeling of the product.

  • Recreational products and vehicles such as helmets, e-scooters, hoverboards, ATVs, portable burners/stove, butane gas cans

Who Is Responsible For My Injury?
